Terms of Service

1. Ownership

Lil Gwapz is an original intellectual-property brand created and owned by Tha GwapSpot. Except for the limited personal-use license below, Tha GwapSpot retains all right, title and interest in the Lil Gwapz name, characters, designs, sticker packs, artwork, expressions, outfits, accessories, logos, marks, slogans, trade dress, downloadable files, metadata, promotional materials, website presentation and official derivative works.

Public access, public GitHub visibility or free download availability does not transfer ownership or place the work in the public domain.

2. Limited personal-use license

Subject to compliance with these Terms, Tha GwapSpot grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to download and use official Lil Gwapz stickers for personal reaction use and ordinary social sharing.

• Personal texts, group chats and direct messages
• Ordinary reactions, comments and personal social posts
• Saving official stickers on your personal devices

This license does not grant merchandising, resale, advertising, commercial-branding, machine-learning, derivative-work, trademark or ownership rights.

3. Commercial use requires permission

Prior written authorization from Tha GwapSpot is required for paid advertising, sponsored campaigns, company branding, product branding, merchandise, print-on-demand products, paid sticker packs, asset bundles, games, apps, publications, media licensing or other uses where Lil Gwapz materially promotes or forms part of a commercial product or service.

4. Prohibited uses

You may not directly or indirectly:

1. Sell, resell, rent, license, sublicense or monetize Lil Gwapz assets.
2. Redistribute the source files, full sticker pack, ZIP archive or substantial parts of the collection as a competing download source.
3. Claim authorship, ownership or exclusive rights in Lil Gwapz.
4. Remove or falsify copyright, provenance or ownership notices.
5. Create confusingly similar brands, characters, mascots, sticker collections or product identities.
6. Trace, redraw or materially alter Lil Gwapz to create an unauthorized derivative collection.
7. Mint, tokenize, wrap, inscribe or represent Lil Gwapz as NFTs, tokens, digital collectibles or blockchain-linked assets.
8. Use Lil Gwapz images, metadata or visual style to train, fine-tune, benchmark or populate AI, machine-learning, generative-media, computer-vision or embedding systems or datasets.
9. Use scraping, bulk extraction or mirroring to reproduce the asset library outside authorized distribution channels.
10. Falsely imply endorsement, sponsorship, partnership or affiliation with Tha GwapSpot.
11. Use Lil Gwapz in unlawful, fraudulent, defamatory, hateful, exploitative, pornographic or materially deceptive content.
12. Use Lil Gwapz in political campaign materials or political endorsements without written authorization.

5. Marks and brand identity

“Lil Gwapz,” “Tha GwapSpot,” associated logos, character identifiers and related visual marks are proprietary brand assets. No trademark or brand license is granted by these Terms. Truthful referential use is permitted only when it does not imply sponsorship or official status.

6. Public repository ≠ open source

The Lil Gwapz source repository may be publicly viewable for deployment, transparency and project presentation. Public visibility does not create an open-source, Creative Commons, public-domain or other general license. Unless a file expressly states otherwise, repository content remains proprietary and all rights are reserved.

7. Enforcement

Where permitted by law, Tha GwapSpot may revoke the limited license, request removal of infringing content or listings, submit copyright or trademark platform notices, issue cease-and-desist demands and pursue legal or equitable remedies. Failure to enforce a provision once does not waive later enforcement.

8. Copyright and infringement reports

To report infringement or unauthorized commercial use, use the official Tha GwapSpot contact and partnership intake at gwapspot.com/contact and provide sufficient information to identify the material, the claimed right and the requested action.

9. Service availability

Tha GwapSpot may update, remove, suspend or modify any part of the Lil Gwapz Services, sticker library, download methods, policies or features at any time.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Lil Gwapz Services and downloads are provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted availability. Nothing here excludes a warranty that cannot legally be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Tha GwapSpot and its owners, contributors, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or business opportunity arising from use of the Lil Gwapz Services.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless Tha GwapSpot and its owners, contributors, contractors and affiliates from claims, liabilities and reasonable costs arising from unauthorized commercial exploitation of Lil Gwapz, infringement of third-party rights, violation of these Terms or unlawful use of the Services.

13. Termination

The limited license terminates automatically upon a material violation of these Terms. After termination, prohibited use must stop and unauthorized copies, listings, products or distributions under your control must be removed where applicable.

14. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Disputes not legally required to be heard elsewhere will be brought in a court of competent jurisdiction in Georgia.

15. Changes and severability

Tha GwapSpot may revise these Terms as Lil Gwapz evolves. The effective date above identifies the current version. If a provision is held unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.

16. Related policies

These Terms operate together with the Lil Gwapz IP Usage Policy and Privacy Policy. A specific written license issued by Tha GwapSpot controls where it expressly grants broader rights.
